法院對LGBTQ+ 權益的肯定 Landmark Court Decisions for LGBTQ+ Rights

香港法院在去年一系列重大裁決中,為多項同志權益奠定了堅實的法律基礎。從「香港終審法院下令政府兩年內確立同性伴侶註冊制度」到「跨性別獲准不需完成全套性別重置手術即可更改身份證上的性別標記」,這些裁決開創了新的LGBTQ+ 權益保障局面。對於企業而言,這是一個值得深入了解的新環境,因為這對企業在香港的運營和員工管理必然有重大影響。

 

In recent landmark decisions, Hong Kong's judiciary strengthened the legal foundation for LGBTQ+ rights.  From the Court of Final Appeal's mandate for the Hong Kong government to establish a same-sex partnership registration system within two years to allowing gender marker changes on IDs without the need for complete gender affirming surgery, these verdicts herald a new era of protection for LGBTQ+ rights. For businesses, it's crucial to grasp this evolving landscape, as it will inevitably influence operations and employee management in Hong Kong.

公共聲音響亮的支持 Resounding Public Support

 

最新2023年的民意調查顯示(註1),香港人對同性婚姻的支持率達60%,更有71%的受訪者認為香港應該制定保障不同性傾向人士免受歧視的法律。在過去十年中,支持保護同志權益的香港市民比例大幅增長,民意發生了積極的變化。這不僅反映了香港社會的價值觀念轉變,也為企業提供融入多元共融信念的機會。

A 2023 public opinion survey reveals (Note 1) a significant 60% approval rate among Hong Kong citizens for same-sex marriage, with a notable 71% supporting for legislation to protect individuals of different sexual orientations from discrimination. Over the past decade, the percentage of Hong Kong citizens endorsing LGBTQ+ rights has surged, marking a positive shift in societal values. This evolving sentiment not only mirrors changing societal norms but also presents businesses with opportunities to integrate inclusive policies.

Hong Kong finds itself at a transformative crossroads concerning LGBTQ+ rights, necessitating an in-depth exploration of the emergent societal dynamics. Beyond a mere corporate imperative, it presents a collective opportunity to foster a more pluralistic and inclusive societal fabric. Our forthcoming conference, "What's Next for LGBTQ+ Equality: The Conference on Exploring New Directions in Corporate Diversity and Inclusion in Hong Kong 2024," serves as a crucible to equip stakeholders for the forthcoming opportunities and intricacies of this evolving milieu. 論壇的目標是深入探討香港在LGBTQ+權益領域的將迎來的新趨勢,促使企業領袖和社會各界共同思考、行動,我們希望這場論壇成為引領香港社會實現更包容文化的重要契機。

 

Our conference is designed to intricately explore the evolving landscape of LGBTQ+ rights within Hong Kong. We seek to inspire business leaders and stakeholders to contemplate and act collectively. Our vision for this conference is to catalyze a more inclusive cultural transformation throughout Hong Kong.

 

討論焦點 Key Focus Areas:

 

  1. 分析法院裁決:深入剖析香港法院多宗重量級裁決中,所確立對LGBTQ+權益保障的法律基礎,並展望其對香港社會帶來什麼改變,更探討這些裁決對企業在運營和員工管理上的將帶來的實際影響,交流企業人才培育、品牌策略和社會影響力的議題。

  2. 企業支持LGBTQ+平等:探討在香港的文化背景中,企業支持 LGBTQ+ 平等的重要性。我們旨在推動各規模企業更包容,並討論多元共融企業的潛在優勢。建立一個合作的環境,讓企業和社會攜手共創包容 LGBTQ+ 的文化氣氛,以迎接香港即將來臨的改變。

  3. 推動多元共融的職場:鼓勵企業及社會領袖分享成功的多元共融策略,特別是在香港文化中實踐的經驗,啟發更多大企業、中小企踏入這一領域,促使企業與社會共同參與,建立對同志包容的文化,並共同迎接香港LGBTQ+權益新時代的機遇和挑戰。

  1.  Judicial Insights:  We will critically examine landmark court rulings in Hong Kong that have cemented the legal framework for LGBTQ+ rights. Our discussions will forecast the societal ripples these decisions are poised to create. Moreover, we'll shed light on how these rulings will reshape business strategies and human resource dynamics. This includes facilitating conversations around talent development, branding strategies, and societal influence.

  2. Corporate Support for LGBTQ+ Equality: Discuss the importance for businesses to promote LGBTQ+ equality in Hong Kong. Tailored to Hong Kong's cultural context, we aim to inspire businesses of all sizes to embrace inclusion and the discuss the potential the benefits for companies. Our goal is a collaborative environment where businesses and society create a culture that celebrates LGBTQ+ inclusivity, preparing for Hong Kong's changing landscape.

  3. Fostering an Inclusive Corporate Culture: The conference encourages sharing of successful diversity and inclusion strategies by business and societal leaders. With a lens focused on Hong Kong's unique culture, we aim to inspire a broader spectrum of enterprises, irrespective of size, to champion inclusion.  We envision a collaborative synergy where businesses and society co-create an environment that celebrates LGBTQ+ inclusivity, preparing them for the challenges and prospects of Hong Kong's evolving landscape.

講者介紹 Meet our Speakers

張天恩律師

Sarina Cheung

張天恩律師 (Sarina) 是 RKS 的顧問律師,專門從事有關遺產承辦及遺囑事宜(包括訂立、認證、執行及有關之訴訟)、信託成立及訴訟、精神健康等有關法律申請,還有提供遺產執行和訴訟服務。

在加入法律界之前,張律師曾在香港一家擁有高度良好信譽的信託及銀行擔任其遺囑管理部門主管,並在那裡累積了超過 10 年信託及遺產方面的執業經驗。她帶領她的團隊參與了一些大型的信託和遺囑管理工作,她對此範疇的專業、熱誠及謀略均得到了同事和客戶的充分信任。在 2018 年,她決定離開銀行的工作,向她的職業生涯邁出一大步,加入了一家專門為私人客戶提供服務的國際律師事務所,經兩年實習後取得了律師資格,再加入了 RKS 並成為其中一員。

Sarina is a consultant of RKS specializing in wills and probate, trust, mental health law and related applications and estate administration and litigation.

Prior to entering the legal industry, Sarina headed the Department of Probate Services in a well-established and reputable trust and banking corporation in Hong Kong and had accumulated over 10 years of experience there as a trust and estate practitioner. She led her team to involve in major trust and probate administrations and was well trusted by her peers and her clients as being professional, passionate, and strategic. In 2018, she made a big career move to be qualified as a lawyer. She was trained in an international law firm specializing in private clients, and stayed there for a year before moving to RKS.

余庭煇博士

Dr Ting-Fai Yu 

Dr Ting-Fai Yu (he/him) is a scholar of queer and transnational Asia. Currently based in Amsterdam, he is a Fellow at the Netherlands Institute for Advanced Study in the Humanities and Social Sciences. His research uses ethnographic and textual-based methods to examine LGBTIQ+ lives and cultures across Chinese-speaking communities in East and Southeast Asia. He has published in field-shaping academic journals, such as Journal of Homosexuality, Journal of Ethnic and Migration Studies, and The Gerontologist. In his other career, Dr Yu is a DEI and intercultural professional. He previously worked at Logitech as the first DEI specialist overseeing the Asia Pacific region. Now working independently and globally, he uses research-informed, evidence-based approaches to support organizations at different stages of their DEI journeys.
